Terms & Conditions

These Terms and Conditions (“Agreement”) form a legal agreement between the user (“Client”) and Sol Studio (the “Designer,” “we,” or “us”) governing the access and use of design services provided by Sol Studio. By engaging our services, you agree to these Terms and Conditions.

GENERAL

Please read these Terms and Conditions carefully. By engaging Sol Studio’s design services, you agree to be bound by these Terms and Conditions. This Agreement is valid upon acceptance and will remain in effect until both parties agree in writing that the services are no longer required.

PAYMENT TERMS

Payment for services will be made in Australian Dollars (AUD) and is due in the following manner:

  1. Initial Payment: 50% of the total fee is required upfront before any work begins. This payment is non-refundable and secures your spot in our schedule.

  2. Final Payment: The remaining 50% is due prior to the release of final files or website launch.

  3. Late Payments: Invoices are due within 14 days. A late fee of 10% will apply if payment is not received within 5 business days of the due date.

  4. Additional Costs: Any additional costs outside of the initial proposal, such as hosting, fonts, stock photography, or third-party software, will be billed separately.

PROJECT PROPOSAL & SCOPE

  1. Quotations: Service quotes are based on the initial brief provided by the Client and the expected time commitment. Quotes are valid for 30 days and are subject to change after this period.

  2. Revisions: Each package includes a set number of revision rounds to ensure your satisfaction. If you need further adjustments beyond the included revisions, additional revisions may be available for an additional fee, based on the scope of work.

  3. Scope Changes: Any changes to the original scope of work must be submitted in writing and will be assessed for additional fees and timelines.

BOOKINGS & CANCELLATIONS

  1. Confirming Your Booking: To confirm your project, a 50% non-refundable deposit is required. The final 50% will be due on the completion date or before the scheduled launch of the project.

  2. Cancellations: You may cancel the project at any time, but the deposit will not be refunded. If the project is terminated midway, you’ll be invoiced for the work completed up until that point.

DELAYS

  1. Client Delays: Timely responses, approvals, and content are critical to the project’s success. Any delays from the Client will extend the project deadline accordingly.

  2. Unforeseen Delays: Delays caused by factors beyond our control (e.g., natural disasters, technical issues) will also lead to adjusted timelines.

TECHNOLOGICAL ADVANCEMENTS

While we strive to ensure your website is secure, we are not liable for any third-party issues like hosting problems, email functionality, or security breaches. For these issues, please contact your hosting provider directly.

DESIGN CREDITS

  1. Designer Credit: Sol Studio retains the right to add a small credit to the footer of the website linking back to Sol Studio’s website unless otherwise agreed in writing.

  2. Portfolio: Sol Studio may showcase your project on our website and in promotional materials unless otherwise requested.

SUPPORT & MAINTENANCE

  1. Post-Launch Support: Once the project is complete and final files are delivered, any additional work or revisions will be billed at an hourly rate of AUD $100.

  2. Website Maintenance: Sol Studio does not provide ongoing website hosting or maintenance. You are responsible for maintaining your website after launch.

INTELLECTUAL PROPERTY RIGHTS

Upon final payment, the Client will receive a license to use the final designs for the purposes outlined in the proposal. However, Sol Studio retains the right to use the design in portfolios, promotional materials, and for other self-promotional purposes unless agreed otherwise in writing.

RUSH SERVICES

If you require expedited services, an additional fee of 25% will be applied for work outside of regular business hours or for projects requiring a quicker turnaround than our standard timeline.

CONFIDENTIALITY

Both parties agree to keep any confidential information, such as business plans, strategies, or proprietary details, shared during the project confidential.

TERMINATION OF AGREEMENT

Either party may terminate this agreement at any time with written notice. In the event of termination, the Client will pay for all services completed up until the termination date.

LIABILITY LIMITATION

Sol Studio is not liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the deliverables. The maximum liability will not exceed the total amount paid for the project.

By accepting the terms outlined in this Agreement, you acknowledge that you understand and agree to the above terms and conditions.
